Abstract

The joint ownership burst in centuries ago and have been modified over time. Therefore, we observe that there is jurisprudence for decades which is still in force today, since the joint ownership and their legislation have practically not changed at all. As we will see later, there are certain problems when it comes to determining the legal personality of community property (whether they have it or not) and the differences that exist with companies (both civil and commercial), that is why we will develop their concepts, similarities and differences. We will also develop how a joint ownership is constituted and what characteristics it must have in order to be considered as such, as well as what situations must occur for them to become extinct. To address these and other issues, a study has been carried out by analysing jurisprudence, which Will document us with real situations.

Las comunidades de bienes irrumpen hace siglos y se han ido modificando con el paso del tiempo. Por ende, observamos que existe jurisprudencia desde hace décadas la cual sigue vigente hoy en día, ya que las comunidades de bienes y su legislación no ha variado prácticamente nada. Como veremos más adelante, existe ciertos problemas a la hora de determinar la personalidad jurídica de las comunidades de bienes (si tienen o no) y las diferencias que existen con las sociedades (tanto civiles, como mercantiles), por eso desarrollaremos sus conceptos, similitudes y diferencias. También desarrollaremos cómo se constituye una comunidad de bienes y qué características ha de tener para que se le considere como tal, además de qué situaciones han de darse para que puedan extinguirse. Para abordar estas y otras cuestiones se ha realizado un estudio de la materia analizando jurisprudencia, la cual nos documentará con situaciones reales.
