Abstract

This final work of final degree show a detailed analysis of the clause resbus sic stantibus. This figure isn’t be regulated by Spanish civil code, for what it’s about a disposition of jurisprudential creation, require in the tribunals in front unexpected situations. The present monograph have the object of plead for the possible codification of the clause rebus and his application in view of the crisis occasioned by the COVID-19. For it, they have been used three investigation techniques: A law study of comparisonwith the rest of the European countries and a short mention to the Latin-American countries, the inquiry approach of codification of the disposition rebus sic stantibus propose in our country and a jurisprudential analysis about the application of the clause in our legal order. Analogously have been making a historic inform of the pacta sunt servanda and the rebus sic stantibus for more later, substantiate its complementation.

Este Trabajo de Fin de grado muestra un análisis de la cláusula rebus sic stantibus. Esta figura no esta regulada en el Código Civil español, por lo que se trata de una disposición de creación jurisprudencial, requerida en los Tribunales frente a situaciones sobrevenidas. El presente trabajo tiene como objetivo, abogar por la posible codificación de la cláusula rebus y su aplicación ante la crisis ocasionada por el COVID-19. Para ello, se han empleado tres técnicas de investigación: un estudio de derecho comparado con el resto de países europeos y breve mención a los estados latinoamericanos, la indagación de las propuestas de codificación de la disposición rebus sic stantibus planteadas en nuestro país y un análisis jurisprudencial sobre la aplicación de tal cláusula en nuestro Ordenamiento Jurídico. De manera análoga, se realiza un informe histórico del principio pacta sunt servanda y de la rebus sic stantibus para posteriormente, fundamentar su complementación.
