Fútbol y derecho internacional público ¿dos mundos separados?.

2022Abstract
The objective of this work is the investigation of the relationship between Public
International Law and sports. In the first place, an analysis of the legalinternational institution of States, its elements and the figure of the recognition of
States is carried out. As a link between the States and football, the fit of FIFA in the
Public International Law´s institutions is studied, as well as the degree of proximity
between the sports federations belonging to said organization and their respective
national governments.
For the purposes of a better investigation, two situations are exemplified, such as
those of the Republic of Kosovo and Western Sahara, which present, for practical
purposes, legal-international singularities that are useful to obtain an answer to
the question raised in the title of the article work: Are football and Public
International Law worlds apart? El presente trabajo tiene como objetivo la investigación de la relación existente
entre el Derecho Internacional Público y el deporte. En primer lugar, se realiza un
análisis de la institución jurídico-internacional de los Estados, sus elementos y la
figura del reconocimiento de Estados. Como nexo entre los Estados y el fútbol, se
estudia el encaje de la FIFA en las instituciones del Derecho Internacional Público,
así como el grado de proximidad existente entre las federaciones deportivas
pertenecientes a dicha organización y sus respectivos gobiernos nacionales.
A efectos de una mejor averiguación, se ejemplifican dos situaciones como las de la
República de Kosovo y el Sáhara Occidental, las cuales presentan a efectos prácticos
unas singularidades jurídico-internacionales que resultan de utilidad para obtener
una respuesta a la cuestión planteada en el título del trabajo: ¿Son el fútbol y el
Derecho Internacional Público mundos separados?
