Evolución histórica del sistema penitenciario en España.

Abstract

The main purpose of this Final Degree Project is to offer a study on the origins and evolution of prisons, from its first antecedents, in Ancient Greece, until the beginning of the 20th century, with the promulgation of the Royal Decree of 1913, precedent of the progressive system of scientific individualization, still in force in many legal systems and included in our current General Penitentiary Organic Law. For this, an approximation to some of the first forms of prison of the time will be offered, emphasizing the "Galeras", the Women's Prisons, as well as the "Houses of Correction" or "Workhouses", which emerged both in Spain as in other countries. Subsequently, the different prison systems that emerged in North America will be analyzed, and the importance that the progressive system of Colonel Montesinos will have in Spain. Likewise, the characteristic notes of the most relevant regulations that arose in the 19th and early 20th centuries will be exposed.

El objeto principal del presente Trabajo de Fin de Grado es ofrecer un estudio sobre los orígenes y la evolución de las prisiones, desde sus primeros antecedentes en la Antigua Grecia, hasta principios del siglo XX, con la promulgación del Real Decreto de 1913, precedente del sistema progresivo de individualización científica, aún vigente en muchos ordenamientos y recogido en nuestra actual Ley Orgánica General Penitenciaria. Para ello, se ofrecerá una aproximación a algunas de las primeras formas de prisión de la época, haciendo hincapié en las “galeras”, en las cárceles de mujeres, así como en las “casas de corrección” o “Workhouses” que emergieron, tanto en España como en otros países. Posteriormente, se analizarán los distintos sistemas penitenciarios que surgieron en Norteamérica y la importancia que tendrá en España el sistema progresivo del coronel Montesinos. Asimismo, se expondrán las notas características de las normativas de mayor relevancia que surgieron en los siglos XIX y principios del siglo XX.
