Minorías religiosas en la comunidad internacional

Abstract

Religious freedom is a right inherent to every democratic state. This freedom is internationally protected and must be guaranteed to every person, regardless of the nature of their beliefs. However, given the plurality of dogmas and convictions existing in current society, the religious beliefs that are less professed, called "religious minorities", such as Islam, Judaism, Buddhism, Hinduism, Protestantism, Jehovah's Witnesses, etc., whose presence in European society is undeniable, are susceptible to serious risks that can be caused both by governments themselves and by individuals. That is why it is up to community law to ensure that these minorities have sufficient protection and that their integration is guaranteed by encouraging Member States to create the essential instruments for this. The purpose of this work is to observe the need to protect religious minorities, considering the right to religious freedom that protects them, without failing to analyze the risks and difficulties that they encounter in their exercise, and at the same time, consider the response of European law in this area.

La libertad religiosa es un derecho inherente a todo estado democrático, el cual se encuentra protegido internacionalmente. Este debe ser garantizado a toda persona, con independencia de la naturaleza de sus creencias. No obstante, dada la pluralidad de dogmas y convicciones existentes en la sociedad actual, las creencias religiosas que son menos profesadas, denominadas “minorías religiosas” -como lo son el islam, judaísmo, budismo, hinduismo, protestantismo, testigos de jehová, etc.-, cuya presencia en la sociedad europea es innegable, son susceptibles de graves riesgos que pueden ser provocados tanto por los propios gobiernos como por particulares. Es por ello por lo que le corresponde al derecho comunitario asegurar que estas cuenten con la protección suficiente y garantizar su integración, incitando a los Estados miembros a crear los instrumentos indispensables para ello. El objeto del presente trabajo es observar la necesidad de proteger a las minorías religiosas, en virtud del derecho a la libertad religiosa que las ampara, sin dejar de analizar los riesgos y dificultades que estas se encuentran en el ejercicio del mismo, y a su vez, contemplar la respuesta del Derecho Europeo en este ámbito.
