El médico y el derecho penal: un estudio histórico y comparado

Abstract

Criminal Law’s actual interest in medical science is mainly based in its most recent developments, in the fields of genetics, artificial intelligence, or neuroscience, for instance. However, the relationship between these two subjects isn’t something new, it began long ago, when Medicine first appeared. This research study invites us to explore the history of the relationship between Medicine and Criminal Law, offering a historical-legal analysis of the regulation, throughout the centuries, of criminal medical responsibility in the Spanish legal system. On the one hand, Statutory Law will be analyzed. On the other hand, the different procedures that are now followed to assess medical negligence. A general view of today’s regulation is offered by studying the reasons that have prompted the great changes of this legal figure since the beginning of humanity.

El actual interés del Derecho penal por la ciencia médica se debe en gran medida a sus recientes avances, desde el campo de la genética hasta la inteligencia artificial, pasando por la neurociencia. No obstante, esta relación no ha surgido en la actualidad, sino que ya quedó establecida desde los orígenes de la propia Medicina. Este trabajo invita a recorrer la historia de la relación entre Medicina y Derecho penal, a fin de que, desde un análisis histórico-jurídico, se pueda comprender mejor la regulación de la responsabilidad penal médica en el ordenamiento español. Se trata, por una parte, del Derecho positivo. Pero también, por otra, de los parámetros normativos actualmente vigentes para la evaluación de la observancia del deber de cuidado por este profesional. Visión del presente que se procura retrotrayéndonos a los distintos motivos que impulsaron los grandes cambios de esta figura jurídica desde los albores de la humanidad.
