2024Abstract
El presente trabajo de fin de máster tiene por objeto analizar la
regulación y aplicación del Derecho Internacional Privado español respecto
de los litigios derivados de un contrato individual de trabajo, con algún
elemento de extranjería. Estas regulaciones las encontramos en las fuentes
del Derecho Internacional privado español: a) las normativas de origen
comunitario, que tienen carácter supranacional; b) las normativas
provenientes de los tratados internacionales de España con otros Estados y
por último, c) la normativa de Derecho Internacional interno. Para la
determinación de la Competencia Judicial Internacional, la determinación
de la ley aplicable y la eficacia de las sentencias de las resoluciones y
sentencias extranjeras en España; acudimos al respectivo sector del Derecho
Internacional Privado aplicable. Estudiamos los Reglamentos Bruselas I bis
y Roma I por ser aplicación exclusiva, cuando esté dentro de su ámbito de
aplicación. Analizamos la Sentencia del TJUE, Voogsgeerd, C-384/10,
pronunciándose sobre la determinación de la ley aplicable en el caso de los
contratos a bordo de buques ante la dificultad en determinar el país en el
cual o a partir del cual el trabajador, en ejecución del contrato realice su
trabajo habitualmente, motivado a los llamados pabellones de conveniencia,
donde a veces no tienen ninguna o escasa relación con el contrato de
trabajo, siendo necesario la utilización de la cláusula de escape cuando del
conjunto de circunstancias resulta que el contrato de trabajo tiene vínculos
más estrechos con otro país, siendo aplicable en este caso su ley.

bis, Reglamento Roma I, lugar habitual de trabajo. The purpose of this master’s thesis is to analyze the regulation and
application of Spanish Private International Law regarding disputes arising
from an individual employment contract, with some element of
immigration. These regulations are found in the sources of Spanish private
international law: a) regulations of community origin, which are
supranational in nature; b) the regulations from the international treaties of
Spain with other States and finally, c) the regulations of internal
International Law. For the determination of the International Judicial
Jurisdiction, the determination of the applicable law and the effectiveness of
the sentences of the foreign resolutions and sentences in Spain; We go to
the respective sector of applicable Private International Law. We study the
Brussels I bis and Rome I Regulations as they are exclusive application,
when within their scope of application. We analyze the Judgment of the
CJUE, Voogsgeerd, C-384/10, ruling on the determination of the applicable
law in the case of contracts on board ships in view of the difficulty in
determining the country in which or from which the worker, in execution of
the contract carry out their work habitually, motivated to the so-called flags
of convenience, where sometimes they have no or little relationship with the
employment contract, it being necessary to use the escape clause when the
set of circumstances results that the contract of work has closer ties with
another country, its law being applicable in this case.
