Directiva 2002/14/CE por la que se establece un marco general relativo a la información y a la consulta de los trabajadores en la comunidad europea

Abstract

Directive 2002/14/EC is one of the directives that has gained the most importance in the last century. Its objective of promoting the participation of workers in the company, establishing a general framework to guarantee compliance with the rights of information and consultation in European companies has meant a great advance in the rights of community workers, but at the same time, The transposition carried out by the Member States has generated numerous questions. Among these we find some such as Where does the need to create Directive 2002/14/EC come from? What influence has it had on the Spanish Regulation? What are the changes that it produces in employment and how does it affect to workers? What are the differences and similarities with respect to other directives that share the same objective? … Consequently, this work aims to reflect on the issues generated by the community legislator, relying on doctrinal expert opinion and jurisprudence.

La Directiva 2002/14/CE es una de las directivas que más importancia ha ganado en el último siglo. Su objetivo de fomentar la participación de los trabajadores en la empresa, estableciendo un marco general para garantizar el cumplimiento de los derechos de información y consulta en las empresas europeas ha significado un gran avance en los derechos de los trabajadores comunitarios, pero a su vez, la transposición llevada a cabo por los Estados Miembros ha generado numerosas cuestiones. Entre estas encontramos algunas como ¿de dónde proviene la necesidad de creación de la Directiva 2002/14/CE?, ¿qué influencia ha tenido en el Ordenamiento Español?, ¿cuáles son los cambios que esta produce en el empleo y de qué manera afecta a los trabajadores?, ¿Cuáles son las diferencias y similitudes con respecto a otras directivas que comparten su mismo objetivo? … Por consiguiente, este trabajo tiene el objetivo de reflexionar sobre las cuestiones generadas por el legislador comunitario, apoyándose en la opinión experta doctrinal y la jurisprudencia.
