Relaciones laborales en el ámbito marítimo: el contrato de embarque internacional.

International labor relations are subject to specific regulations that
at least present one element of the inmigration laws, either the nationality of
the company and / or the worker and / or the place where the services are
provided; These private international situations are the subject of Private
International Law (DIPr).
The "communitarization or Europeanization" is the phenomenon of
approximation of laws in the field of DIPr in the Member States of the
European Union, ensuring normative homogeneity in the regulation of
international judicial compentence and the applicable labor law in the field
of international employment contract.
In this work, we also analyze the problem of the work provided on
board ships in the current; the minimum standards established by the
Maritime Labor Convention and how they must be applied in the shipping
contract, the confusion and difficulty in identifying the maritime
entrepreneur, the existence of different flag of convenience and the problem
in determining the applicable law to boarding contract. Las relaciones laborales internacionales son objeto de regulación
específica al tratarse de situaciones privadas que presentan al menos un
elemento de extranjería, sea la nacionalidad de la empresa y/o del
trabajador y/o el lugar de la prestación de los servicios; estas situaciones
privadas internacionales son objeto del Derecho Internacional Privado
(DIPr).
La “comunitarización o europeización” es el fenómeno de
aproximación de legislaciones en materia de DIPr en los Estados miembros
de la Unión Europea, garantizando la homogeneidad normativa en la
regulación de las situaciones privadas internacionales mediante
Reglamentos comunitarios que determinan la competencia judicial
internacional y el derecho laboral aplicable en materia de contrato de
trabajo internacional.
En este trabajo analizamos asimismo la problemática de los trabajos
prestados a bordo de buques en el contexto actual; las normas mínimas que
establece el Convenio sobre el Trabajo Marítimo y que deben regir en
contrato de embarque, la confusión y dificultad para identificar al
empresario marítimo, la existencia de pabellones o banderas de
conveniencia y el problema a la hora de determinar la ley aplicable al
contrato de embarque.
